{"id":13515,"date":"2026-04-20T16:42:05","date_gmt":"2026-04-20T13:42:05","guid":{"rendered":"https:\/\/www.emn.ee\/?p=13515"},"modified":"2026-04-22T14:49:12","modified_gmt":"2026-04-22T11:49:12","slug":"newly-published-emn-inform-focuses-on-safe-countries-of-origin-and-safe-third-countries","status":"publish","type":"post","link":"https:\/\/www.emn.ee\/en\/newly-published-emn-inform-focuses-on-safe-countries-of-origin-and-safe-third-countries\/","title":{"rendered":"Newly published EMN inform focuses on safe countries of origin and safe third countries"},"content":{"rendered":"\n<p>The EMN inform <em><a href=\"https:\/\/www.emn.ee\/en\/publication\/safe-countries-oforigin-and-safe-thirdcountries-criteriafor-identifying-andexamining-applications-inlight-of-the-new-asylumprocedure-regulationeu-2024-1348\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Safe countries of origin and safe third countries: criteria for identifying and examining applications in light of the new Asylum Procedure Regulation (EU) 2024\/1348<\/strong><\/a><\/em> presents the following key takeaways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A safe country of origin (SCO)<\/strong> is a country where, on the basis of the legal situation, application of the law within a democratic system and general political circumstances, it can be shown that there is generally and consistently no persecution as defined in Article 9 of Directive 2011\/95\/EU, no torture or inhuman or degrading treatment or punishment, and no threat by reason of indiscriminate violence in situations of international or internal armed conflict.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A safe third country (STC)<\/strong> is defined as a third country that treats a person seeking international protection in accordance with the following principles, notably: life and liberty are not threatened on account of race, religion, nationality, membership of a particular social group or political opinion; there is no risk of serious harm as defined in the recast Qualification Directive; the principle of non-refoulement in accordance with the Geneva Refugee Convention and Protocol is respected; the prohibition of removal, in violation of the right to freedom from torture and cruel, inhuman or degrading treatment as laid down in international law, is respected; the possibility exists to request refugee status and, if found to be a refugee, to receive protection in accordance with the Geneva Refugee Convention and Protocol.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Of 26 European Migration Network (EMN) Member Countries and Serbia,19 indicated using a national list of safe countries of origin (SCO)s. Finland and Portugal apply the SCO concept on a case-by-case basis.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Estonia, Malta and Luxembourg have territorial or group exceptions to the application of the SCO concept on the basis that applicants coming from certain regions or belonging to specific categories of people may still face risks of persecution or serious harm.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Twenty countries use an accelerated procedure to examine the applications of individuals coming from<br>SCOs. The timeframe for filing appeals differs significantly between countries, ranging from one week in the Netherlands to 30 days in Finland or one month in France. Bulgaria, the Netherlands and Slovakia exclude unaccompanied minors from the accelerated procedure. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Of the countries applying the STC concept, 17 EMN Member Countries reported conducting the mandatory individual assessment to determine that the STC concept may be applied to a particular applicant.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cyprus, Hungary and Malta apply a geographical and\/or group exception to the use of the STC concept.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Six countries reported challenges in applying the STC concept.
